This was a serious breach of these individuals’ privacy, and caused them to suffer discrimination, as well as exposing them to an elevated risk of eviction, loss of employment and violent home invasions.
Bisbicis Law Corporation and the Law Offices of Michael McCubbin filed a proposed class action proceeding in the Supreme Court of British Columbia claiming damages, or financial compensation, and other relief against the Minister of Health, named in the lawsuit as the Attorney General of Canada, for this privacy breach. The representative plaintiff in the proceeding is T.S., a small business owner and entrepreneur who has successfully managed his chronic pain with the help of medical marijuana, and who received one of the pieces of correspondence referenced above.
