A class action allows a group of individuals who all have a claim against a defendant based on essentially the same facts to have the common issues between their claims adjudicated together in a single court proceeding. This saves each individual plaintiff from having to incur the expense and effort associated with bringing a separate claim, and allows individuals to pursue claims they may not have otherwise been able to. This is because the potential damage award that may be recovered does not justify the time and expense associated with pursuing separate, individual lawsuits.
